April 2022: The MDL Paraquat class action judge will have a status conference on April 1st to review where the litigation is headed and how best to take the bellwether lawsuits forward for trial in November 2022. 44 new paraquat lawsuits have been added to the MDL in the last two weeks. At this pace, April 2022 will be the busiest month for new files yet. Last week, the parties filed their class-action bellwether picks with the Paraquat MDL judge. Those choices, however, have not been made public.
May 2022: In the last month, over 50 new cases have been added to the Paraquat Lawsuit Multidistrict Litigation (MDL). A group of six patients was recently selected by the Paraquat MDL court for the initial Paraquat Parkinson's disease bellwether trials. As a result, the first trial in November 2022 is approaching soon. The strategy is to select 16 paraquat claims from among the almost 1000 Parkinson's disease litigation claims filed. Following some limited fact discovery in these instances, paraquat attorneys on both sides submitted a preference list to the MDL court, ranking the 16 cases in order of priority. Attorneys for plaintiffs seek the finest facts for their clients, while defense attorneys want the worst. The judge whittled the list down to six Paraquat claims based on these rankings.

Foshay Learning Center in Los Angeles has been linked to several high-profile abuse matters, most notably the case of assistant principal Steve Thomas Rooney, whose conduct with a Foshay student later came to light through reporting and court testimony. In May 2008, the former student testified that the relationship began when she was 15, that she disclosed it to a Foshay administrator and was urged to recant, and that she at times lived with Rooney, became pregnant, and traveled with him while still underage. The district’s handling of Rooney drew sharp criticism. After Rooney was arrested in February 2007 for allegedly pointing a gun at the student’s stepfather, Los Angeles Unified School District first placed him on desk duty and then transferred him to Markham Middle School. LAPD leadership later said LAUSD officials already knew by spring 2007 that Rooney was suspected of having sex with a Foshay student.

Another case at Foshay in 2008 involved band instructor Lief Arnesen Albaugh, who was charged with possessing child pornography after investigators said images were found on personal and district-issued laptops. Later that year, a judge ordered him to stand trial on two felony counts. As for civil litigation, coverage around Rooney’s 2009 sentencing reported that three of the four victims had filed civil suits against LAUSD. Public reporting does not identify Foshay-specific settlement figures; some cases may have resolved confidentially. At a districtwide level, LAUSD’s board in June 2025 authorized up to $500 million in bonds to help fund sexual-assault settlements involving current and former students.
